Terms of Service

SCF Pulse is a product of Senior Care Finder (“Senior Care Finder,” “we,” “our,” or “us”). By accessing or using SCF Pulse (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, you may not access or use the Service. 

1. Acceptance of Terms 

By registering for or using SCF Pulse, you acknowledge that you have read, understood, and agree to these Terms. We may modify or update these Terms at any time, and your continued use of the Service following any changes constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically. 

2. Description of Service 

SCF Pulse provides tools and services for monitoring, managing, and analyzing online customer reviews and feedback. We may modify, suspend, or discontinue any features, functions, or aspects of the Service at any time without prior notice. Senior Care Finder is not liable for any modification, suspension, or discontinuation of the Service. 

3. User Accounts 

To access certain features of SCF Pulse, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Senior Care Finder is not responsible for any loss or damage resulting from your failure to safeguard your account information. 

4. User Conduct 

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not post, transmit, or otherwise make available content that is unlawful, defamatory, infringing, harmful, or otherwise objectionable. You must comply with all applicable laws and the policies of third-party platforms when soliciting reviews. You are strictly prohibited from engaging in “review gating” or any practice that selectively solicits only positive reviews, or from otherwise attempting to manipulate the feedback process. 

5. Third-Party Provider Terms 

Customer understands and acknowledges that it is bound by all terms of service and agreements with SCF Pulse’s third-party providers which, if violated, would constitute a breach of SCF Pulse’s obligations under SCF Pulse’s agreements with third-party service providers. Any such terms of service are available to Customer for review upon request. 

6. Intellectual Property and Content Submissions 

All content, software, and features of SCF Pulse are owned by Senior Care Finder or its licensors and are protected by intellectual property laws. By submitting content, feedback, suggestions, or other materials through the Service, you grant Senior Care Finder a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable license to use, reproduce, modify, display, distribute, and create derivative works of such content for the purpose of operating, promoting, and improving the Service. You represent and warrant that you have all rights necessary to grant this license. 

7. Privacy 

The collection, use, and disclosure of your personal information is governed by our Privacy Policy. In the event of any conflict between these Terms and the Privacy Policy, the Privacy Policy will govern with respect to privacy and data protection. 

8. Fees and Payment 

Users agree to pay all fees associated with the Service as outlined in the applicable subscription or purchase agreement. All payments are due as specified and must be received in full. Senior Care Finder reserves the right to modify its fees or billing practices at any time upon notice to Users, and your continued use of the Service after any such changes constitutes acceptance of the updated fees. Users are responsible for all applicable taxes and other charges related to their use of the Service. 

9. Disclaimer of Warranties 

The Service is provided on an “as-is” and “as-available” basis. Senior Care Finder makes no warranties, express or implied, regarding the Service’s availability, accuracy, reliability, completeness, or fitness for a particular purpose. You acknowledge that your use of the Service is at your sole risk. 

10. Limitation of Liability 

To the fullest extent permitted by applicable law, Senior Care Finder, its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or use, arising out of or relating to your access to or use of the Service. In no event shall Senior Care Finder’s total liability to you exceed the total fees paid by you for the Service during the twelve (12) months preceding the claim. 

11. Indemnification 

You agree to indemnify, defend, and hold harmless Senior Care Finder, its affiliates, officers, employees, and licensors from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorney’s fees, arising out of or related to your use of the Service, violation of these Terms, or infringement of any intellectual property or other rights of a third party. 

12. Termination 

Senior Care Finder reserves the right, at its sole discretion, to suspend or terminate your access to the Service, with or without cause, at any time. Upon termination, your right to use the Service will immediately cease. Any fees paid are non-refundable except as required by law or as otherwise specified in a separate agreement. 

13. Governing Law and Dispute Resolution 

These Terms are governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Nebraska for the resolution of any disputes arising out of or relating to these Terms or your use of the Service. 

14. Miscellaneous 

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Senior Care Finder regarding the Service and supersede any prior agreements. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Senior Care Finder may assign or transfer its rights and obligations under these Terms at any time without notice. You may not assign these Terms without our prior written consent.
